EPA Grants Emergency Waiver to Boost Gasoline Supply, Cut Prices at the Pump

WASHINGTON, August 21, 2026– An emergency fuel waiver has been granted by the Environmental Protection Agency. The decision seeks to boost supplies of gasoline.

The waiver comes after consultation with the Department of Energy. It was issued under the Clean Air Act. EPA noted that the agencies agreed that the action was in the public interest.

Effective from September 1, 2026, the waiver allows increased volatility E10 sales. E10 refers to gasoline that contains 10% ethanol, at a higher Reid Vapor Pressure. This action effectively finishes the low-volatility summer-blend gasoline requirement early rather than enforcing a sudden and full transition to winter-grade fuel.

Summer-blend gasoline contains certain volatility limitations. The volatility restrictions are designed to control emissions during hot weather periods. The waiver will allow the switch to winter gasoline.

The EPA expects the decision to increase supplies by hundreds of thousands of barrels each day. This figure is based on improved refining and distribution capabilities. Lower gasoline prices are still expected to follow, though not assured.

The waiver will run until September 15, 2026. This marks the end of the federal summer control period.

Additionally, EPA has waived certain state-level regulations. The states affected by the waivers include Texas, Arizona and California. These can be waived for up to 20 days.

The agency noted that it will keep a watch on the fuel supply situation. Action could be taken depending on the supply situation. Certain local measures lie under the purview of individual states.

Emergency waivers have been used by EPA in the past. This tool can be used to respond to fuel supply problems or market anomalies. In fact, the agency has issued them following storms or refinery shutdowns.

This recent waiver is intended to facilitate the fuel supply process. It provides prior notice about the September switch. Fuel suppliers will find it easier to manage their inventories.

The real effect on prices will depend on other factors in the market. Costs of crude oil, refinery production and local demand are some factors.

EPA Administrator Lee Zeldin spoke about the administration’s energy costs emphasis. He noted that the administration has already acted decisively in regard to fuel supply. In addition, the decision makes gasoline affordable for people’s households.

“Increasing the supply of gasoline means lower prices for American families,” said DOE Secretary Chris Wright. “Today’s action is another example of this Administration using every available tool to cut red tape, increase the supply of gasoline, and lower prices at the pump. Thanks to President Trump’s leadership, we are advancing commonsense policies that prioritize energy addition and put the American people first. 

The emergency fuel waivers have been issued by the agency since May 1, 2026. They allowed the elimination of fuel restrictions across the country. States that followed suit faced decreased gas prices, according to the agency.

The EPA stated that the waivers can be extended if necessary. The agency will monitor the supply situation in the following weeks. More steps may be expected depending on the situation.

The waiver is a part of the campaign aimed at reducing dependence on imports. The purpose of the initiative is to make the country independent of foreign energy thanks to the rule-making process.
